The Center for Data Innovation submitted this response to the Bureau of Industry and Security’s (BIS) proposed rule to establish reporting requirements for the development of advanced artificial intelligence (AI) models and computing clusters.

The proposed rule requires companies developing large, dual-use AI models to report development details, ownership, and cybersecurity to the U.S. government. It also applies to companies with large computing clusters. However, using computing thresholds may miss high-performing models and could burden open-source projects, hindering innovation.
